Trust Modification / Termination

Irrevocable trusts can achieve many estate planning, goals and objectives. Irrevocable trusts are designed to be permanent, and can be difficult to modify or terminate, as the name suggests. However, as circumstances change, a trust may no longer properly serve the original trust makers objectives. Alternatively, if laws change, then the originally designed irrevocable trust may not be the most effective way of accomplishing that person’s goals. While modifying or terminating an irrevocable trust can be difficult, Florida law allows a number of ways to modify your trust.

Some common situations that come up where an individual or family may want to modify an irrevocable trust are as follows:

  • Changes in tax laws: if there are significant changes in tax laws, especially those that affect a trust, the original trust creator (often called settler or grantor), or their family may want to modify the trust to take advantage of new opportunities for tax savings or to adapt to evolving, legal landscapes.

  • Beneficiary needs: changing financial or personal circumstances of beneficiaries, such as health issues, educational needs, or unexpected financial challenges may prompt a trust modification to better address those needs

  • Family dynamics: shifts in family dynamics, such as births, marriages, divorces, or other situations, can influence a trust’s creator or their families’ desire to modify the trust to accommodate new family members or to address other situations.

Additionally, we try to build flexibility into those trusts so that changes in circumstances or laws can be accommodated in the future.

However, if the flexibility that was built-in is not adequate, or if another attorney built a trust without flexibility to address future changes, there are still a number of methods to modify or terminate an otherwise irrevocable trust. The services at the Bruce Estate Law firm include analyzing the trust to determine if a modification or termination is permissible, discuss with the settlor (if still living and competent), and/or their family to determine if a modification or termination truly does address the change in circumstances without creating additional or unforeseen problems, and advising on the best method to accomplish those that modification or those changes. Sometimes the best method to accomplish a modification or termination is going through the court system. If court intervention is necessary, then we will file and are ready to represent you in court to advocate for these changes in front of the appropriate judge.
